Update on the Scottish Living Wage

For ILF recipients who employ personal assistants

ILF Scotland will increase your award to enable you to pay the new Scottish Living Wage rate of £8.75 for every active (wakened) hour of daytime support you receive from your personal assistants.

For overnight hours of support the hourly National Minimum Wage rate (currently £7.83) will still apply.

ILF Scotland will also provide you with an additional amount of money so that you can back date the payment of the Scottish Living Wage to the 1st May 2018. You must pass this payment on to your personal assistants. If you use a payroll agency, you should contact them requesting their support in calculating how much back pay your personal assistants are due.

For ILF recipients who use agency support

We previously applied an uplift payment of 6% to cover every active (wakened) hour of daytime support provided by agencies from 1st October 2016 to 30th April 2017. A further automatic increase of 2.5% to this uplifted amount was applied on 1 May 2017 to reflect the new higher rate of the Scottish Living Wage (SLW) at this time.

As annual SLW increases move to a normal part of business activity, we will not be applying blanket uplifts for agency support going forward, but will manage things through ILF Scotland Award Managers on a case by case basis, and through one of two possible approaches:

1. ILF Scotland’s assessors will assess recipients’ awards for SLW compliance as part of their routine assessment visits. Where non-compliance is identified, it will be addressed. However, please note that we will use local framework rates as guidance.

2. ILF Scotland Award Managers can, at any time, request from ILF Scotland an uplift to their rate to facilitate payment of the SLW. Where appropriate, we will authorise and implement this uplift.
